The Nominee hereby freely, voluntarily, and without duress executes this Release under the following terms:

1. Release and Waiver. Nominee does hereby release and forever discharge and hold harmless Hot Mess Express Rescue and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that arise or may hereafter arise from Nominee’s  Activities with Hot Mess Express Rescue.

NOMINEE UNDERSTANDS THAT THIS RELEASE DISCHARGES HOT MESS EXPRESS RESCUE FROM ANY LIABILITY OR CLAIM THAT THE VOLUNTEER MAY HAVE AGAINST HOT MESS EXPRESS RESCUE WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM NOMINEE’S  ACTIVITIES WITH HOT MESS EXPRESS RESCUE, WHETHER CAUSED BY THE NEGLIGENCE OF HOT MESS EXPRESS RESCUE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS OR AGENTS OR OTHERWISE. NOMINEE  ALSO UNDERSTANDS THAT HOT MESS EXPRESS RESCUE DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.

2. The Nominee agrees to have information about their home and situation shared with potential volunteers. 

 

3. The Nominee will provide the volunteers with a safe working environment. This includes relaying any information that could affect the health of volunteers both before and after the initial walk through is completed. 

 

4. The Nominee agrees that Hot Mess Express is not liable for any damages done to the home during the mission. 

 

5. The Nominee agrees that Hot Mess Express is not liable for any lost or damaged items. This includes discoveries made both during and after the mission. 

 

6. The Nominee is responsible for providing any specialized cleaning products that may be required. The Nominee agrees that Hot Mess Express  is not liable for allergies and illnesses caused by the cleaning products we provide.

 

7. Hot Mess Express is not liable for any injuries the Nominee may sustain during the walkthrough or mission. 

 

8. The Nominee agrees that Hot Mess Express is not indebted to return and complete any unfinished cleaning or projects once the mission has reached its end time. 

 

9. Photographic Release. Nominee does hereby grant and convey unto Hot Mess Express Rescue all right, title, and interest in any and all photographic images and video or audio recordings made by Hot Mess Express during the Nominee’s  Activities with Hot Mess Express Rescue, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

 

10. Other. Nominee expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of North Carolina, and that this Release shall be governed by and interpreted in accordance with the laws of the State of North Carolina. Nominee also agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
